Can Rights be Taken Away?

As ever with rum and rights, this week’s topic was both controversial and somewhat open-ended, and our discussion was correspondingly multi-faceted. At first, there seem to be two central debates running in parallel here: a normative question about the flexibility of our moral laws and a more fundamental one concerning the very nature of ‘rights’. Though related, the two issues are significantly distinct – the first is asking us whether, irrespective of our opinion about the nature of rights, it is right for them to be broken or ignored in a particular circumstance, whereas the second is asking whether or not it even makes sense for us to say that a right has been ‘taken away’ at all, whether or not we believe this to be right or wrong.

However, as our resident Kantian John Ward pointed out, on closer inspection these questions are entirely inextricable. Rights simply express inviolable moral laws (that is, moral laws that it would be morally impermissible to transgress, such as ‘do not kill’) from another perspective. Every right for a particular individual is a constraint on the way that other individuals may treat them. Rights just are what it is morally permissible and impermissible to do, so if you accept that there are rights (i.e. that there are moral laws which it is impermissible to break) then one must also admit that they can never be taken away, since a right is an expression of an inviolable moral law, or a deontological constraint. Now this argument sounds convincing, but it has a terrifying conclusion that no reasonable person could accept. In our end of session vote there was a markedly different response to the question ‘can rights be taken away’ and ‘should rights be taken away’, a distinction which on John’s theory is inconsistent. If his argument is conclusive, therefore, the seemingly impervious reputation of Rum and Rights for the highest standards of critical thought and reasoning will be ruined; and I needn’t point out that such an occurrence would wreak havoc on the international stage. With this bastion of stability and rigour discredited, nobody could be certain of anything. Faith in public institutions would tumble even further than they already have, stock markets would crash as consumer confidence disappeared overnight: anarchy would descend (God forbid). Thus, in the interests of securing our great club’s good name, and indeed the future of humankind, I must attempt to formulate an internally consistent account of how the view expressed in the opening paragraph (i.e. that there is a difference between the normative question of whether or not rights should be taken away and the more meta-ethical question of whether or not they in fact can be taken away) can be defended.

The first point to be made about this response is that it cannot be deontological. In order to refute John’s conclusion, we must refute his premise – i.e. that there are rights, in the sense that there are inviolable moral laws. However,  it is possible that rejecting deontological forms of morality does not entail rejecting the claim ‘there are rights’, and equally does not entail rejecting the claim ‘there are some moral laws that we should never break’. The first claim can be maintained by reinterpreting the idea of a right’s ‘existing’ as saying not that there are morally inviolable laws, but rather that there are concepts, which are referred to as rights and which are upheld by a considerable proportion of the population and which have a tangible effect on the way people behave. The first is a somewhat controversial claim about the nature of ethics, whereas the second is an irrefutable empirical claim about the world. Additionally the second claim (that we shouldn’t break some ‘rights’) can be maintained with recourse to this second, empirical claim about rights rather than the first, stronger claim. By endorsing a form of rule-utilitarianism for example, it could be held that ‘rights’ have no intrinsic moral worth, but that endorsing them and never breaking them would maximise happiness in the long run nonetheless. In this fashion the three claims ‘rights exist’ (i.e. there are observable social phenomena called rights), ‘deontological constraints don’t exist’ (i.e. there are no intrinsically inviolable moral laws, or deontological constraints) and ‘there are some moral laws that we should never break’ (e.g. it is in the long run interests of a maximising utilitarian to never break a particular moral law) can be simultaneously maintained and it can be argued that rights can be taken away, but that they should not be. The world can breathe a sigh of collective relief.

In other words, there must be at least one person at Rum and Rights that thinks that rights cannot be taken away, but that people should be able to take them away nonetheless. More worryingly, there are six people who do not believe in natural rights, but do believe in a most important natural right. Rationalising this set of results will take a braver man than myself. WASHINGTON — The Supreme Court on Friday overturned the landmark Roe v. Wade ruling that guaranteed a constitutional right to abortion, a momentous break from a half-century of rulings on one of the nation’s most contentious issues. About half the states have already indicated they would move to ban the procedure.

The court ruled 6-3 to uphold a Mississippi abortion ban being challenged in the case and 5-4 to overturn Roe. In the majority opinion, Justice Samuel Alito wrote that the court’s decision in Roe “sparked a national controversy that has embittered our political culture for a half century.”

Legal scholars said the decision to overrule Roe is one of the few times the Supreme Court has ever invalidated an earlier decision that declared a constitutional right — and the only time it took away a right that had considerable public support.

The ruling came in a dispute over a 2018 law passed by Mississippi’s Republican-controlled Legislature that banned abortions after 15 weeks. The law, which made exceptions for medical emergencies or cases of severe fetal abnormality but not for rape or incest, was immediately challenged and put on hold by lower courts.

The law constituted a direct attack on the court’s landmark 1973 Roe v. Wade decision as well as a follow-on ruling in 1992, Planned Parenthood v. Casey, under which states could impose some restrictions on abortion before viability, provided they did not constitute an “undue burden” on the right of access to the procedure. But flat-out bans before viability, generally considered to be about 24 weeks into a pregnancy, were deemed to be unconstitutional.

Those rulings are no longer the law of the land, in part because of the court’s changed composition. Two members of the court who joined in its earlier abortion decisions, Ruth Bader Ginsburg and Anthony Kennedy, were succeeded by justices appointed by then-President Donald Trump: Amy Coney Barrett and Brett Kavanaugh. Trump had declared that he would put “pro-life justices on the court.”

«We hold that Roe and Casey must be overruled,» Alito wrote in the opinion, which was backed by Justices Clarence Thomas, Neil Gorsuch (also appointed by Trump), Kavanaugh and Barrett. «The Constitution makes no reference to abortion, and no such right is implicitly protected by any constitutional provision, including the one on which the defenders of Roe and Casey now chiefly rely — the Due Process Clause of the Fourteenth Amendment.»

«It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives,» he wrote, calling the original Roe decision «egregiously wrong and deeply damaging.»

In a concurring opinion, Kavanaugh noted that states retained the power to limit or grant the right to an abortion.

«After today’s decision, all of the States may evaluate the competing interests and decide how to address this consequential issue,» he wrote.

Thomas, meanwhile, called on the court to revisit other decisions, including on contraception and same-sex marriage, in his opinion agreeing with the majority ruling. He wrote that he would do away with the doctrine of «substantive due process» and explicitly called on the court to overrule the rulings in Griswold v. Connecticut, on the right to contraception; Lawrence v. Texas, on the right to same-sex intimacy; and Obergefell v. Hodges, on the right to same-sex marriage.

“As I have previously explained, ‘substantive due process’ is an oxymoron that ‘lack[s] any basis in the Constitution,’” he wrote.

Chief Justice John Roberts joined the other conservative justices in the decision to uphold the Mississippi law, but he urged in a concurring opinion against going further.

«Surely we should adhere closely to principles of judicial restraint here, where the broader path the Court chooses entails repudiating a constitutional right we have not only previously recognized, but also expressly reaffirmed applying the doctrine of stare decisis,» Roberts wrote. 

In a furious dissent, liberal Justices Stephen Breyer, Elena Kagan and Sonia Sotomayor said the court «reverses course today for one reason and one reason only: because the composition of this Court has changed.»

“Whatever the exact scope of the coming laws, one result of today’s decision is certain: the curtailment of women’s rights, and of their status as free and equal citizens,” the justices added.

«With sorrow — for this Court, but more, for the many millions of American women who have today lost a fundamental constitutional protection — we dissent,» they concluded.

Biden, lawmakers press for codifying Roe

The court’s ruling does not make abortion illegal, but with access to the procedure no longer deemed a constitutional right, states can now move to ban it. 

Supporters of abortion rights were bracing for the loss after an early draft of the opinion was leaked in May, touching off several days of demonstrations in more than two dozen cities. Protesters even showed up outside the homes of some members of the court.

Alarmed by the prospect that Roe would be overturned, Democrats in Congress responded to the leak by holding a Senate vote to advance legislation that would guarantee access to abortion nationwide. The bill was blocked, however, in a largely party-line vote. 

President Joe Biden said in remarks from the White House that Friday’s ruling was «a tragic error by the Supreme Court» that had put women’s health and lives «at risk.»

The president vowed to do what he could to keep abortion accessible, but he said the «only way we can secure a woman’s right to choose is for Congress to restore the protections of Roe v. Wade as federal law.» That can’t be accomplished without more Democrats in the House and Senate, Biden said, meaning, «This fall, Roe is on the ballot.»

Democratic leaders in Congress swiftly condemned the ruling. Senate Majority Leader Chuck Schumer, D-N.Y., said the decision marked «one of the darkest days our country has ever seen. Millions upon millions of American women are having their rights taken from them by five unelected Justices on the extremist MAGA court.» 

House Speaker Nancy Pelosi, D-Calif., suggested at a news conference that the Trump-appointed justices who joined in the majority decision had lied when they told senators during their confirmation hearings that they respected the precedent of past rulings.

“Today, the Republican-controlled Supreme Court has achieved the GOP’s dark and extreme goal of ripping away women’s right to make their own reproductive health decisions,” she said in a statement after the ruling. “Because of Donald Trump, Mitch McConnell, the Republican Party and their supermajority on the Supreme Court, American women today have less freedom than their mothers.”

Centrist Sen. Joe Manchin, D-W.V., said he was “deeply disappointed” by the ruling and singled out Kavanaugh and Gorsuch, whom he voted to confirm, for backing the overturning of Roe.

“I trusted Justice Gorsuch and Justice Kavanaugh when they testified under oath that they also believed Roe v. Wade was settled legal precedent and I am alarmed they chose to reject the stability the ruling has provided for two generations of Americans,” Manchin said. While he considers himself pro-life, he said he supports «legislation that would codify the rights Roe v. Wade previously protected. I am hopeful Democrats and Republicans will come together to put forward a piece of legislation that would do just that.”

Sen. Susan Collins, R-Maine, a moderate who also voted to confirm Gorsuch and Kavanaugh, called the ruling «ill-considered» and suggested that she, too, had been misled. “This decision is inconsistent with what Justices Gorsuch and Kavanaugh said in their testimony and their meetings with me, where they both were insistent on the importance of supporting long-standing precedents that the country has relied upon,” she said. Collins added that she, too, would continue to push for legislation to codify the rights that had been enshrined by previous court precedent.

In response to the ruling, the Senate Judiciary Committee tweeted that it “will hold a hearing next month to explore the grim reality of a post-Roe America.” 

Trump and other Republicans praise decision

Former President Donald Trump, who nominated three of the justices who voted to overturn Roe, told Fox News that Friday’s decision is “following the Constitution, and giving rights back when they should have been given long ago.”

In a statement a short time later, Trump called the ruling «the biggest WIN for LIFE in a generation.» He said it was «only made possible because I delivered everything as promised, including nominating and getting three highly respected and strong Constitutionalists confirmed to the United States Supreme Court.» 

House Minority Leader Kevin McCarthy, R-Calif., also praised the court’s action. “Every unborn child is precious, extraordinary, and worthy of protection. I applaud this historic ruling, which will save countless innocent lives,” he said. “The Court is right to return the power to protect the unborn to the people’s elected representatives in Congress and the states.”

Senate Minority Leader Mitch McConnell, the Kentucky Republican who reshaped the balance of the court by refusing to hold confirmation hearings for then-President Barack Obama’s Supreme Court nominee and later rushed Trump’s nomination of Barrett, hailed the ruling as «courageous and correct. This is an historic victory for the Constitution and for the most vulnerable in our society.”

The court’s decision was a huge victory for supporters of Mississippi’s law, who argued that the state measure was intended to regulate “inhumane procedures” and argued that a fetus is capable of detecting and responding to pain by that point in a pregnancy.

But Friday’s ruling was a bitter defeat for advocates of abortion rights, who struggled to maintain them while courts narrowed their application over the past five decades.

“Knowing this moment would come does not make it any less devastating,” Alexis McGill Johnson, president of the Planned Parenthood Action Fund, said. “The Supreme Court has now officially given politicians permission to control what we do with our bodies, deciding that we can no longer be trusted to determine the course for our own lives.”

The Center for Reproductive Rights had urged the court to maintain its earlier abortion rulings that upheld a right of access to abortion.

“Two generations have now relied on this right, and 1 out of every 4 women makes a decision to end a pregnancy,” Julie Rikelman, a lawyer for the group, told the justices.

Lawyers for Mississippi, however, said the law would have a minimal impact on women in the state because its only abortion clinic does not perform the procedure after 16 weeks. More than 90 percent of abortions take place before or during the 13th week of pregnancy, they said.

Texas case foreshadowed ruling

The court’s decision was the second ruling this term limiting access to abortion. In December, the court allowed a Texas law to remain in force while lower court challenges are underway. The law effectively bans abortion after six weeks of pregnancy by authorizing lawsuits against abortion providers or anyone who assists them. 

Its unorthodox method of enforcement was intended to get around the Supreme Court’s earlier abortion rulings that prevented states from simply banning abortion directly. But last June, Gov. Greg Abbott, a Republican, signed a law that would ban abortion in the state within 30 days after a ruling striking down Roe.

In about half the country, abortion is soon likely to be illegal. Texas is one of about two dozen states that were considered certain or likely to ban abortion once the Supreme Court’s abortion precedents were overturned. Thirteen of those states already have measures known as trigger laws, intended to take effect when Roe was overturned or shortly after.

But abortion will remain legal in the other half of the nation, including in such populous states as California, New York, Illinois, New Jersey, and Pennsylvania.

Мы насчитали минимум 65 фразовых глаголов и их значений с take — и не исключено, что есть и еще. Но в этой статье приведем примеры наиболее распространенных, которые носители языка часто используют в быту. Естественно, с кучей примеров. Поехали.

Take away

У глаголов с take очень большая вариативность, которая зависит от контекста. Поэтому начнем с take away и его значений.

На курсах английского языка обычно изучают четыре значения фразы, а еще одно остается неизвестным вплоть до уровня Advanced или даже Fluent.

Первое и основное значение — забирать, убирать, перемещать. Причем оно отлично работает как в прямом, так и в переносном значении.

If you have five apples and take away two, you’re left with three. — Если у тебя есть пять яблок, а потом убрали два из них, у тебя останется три.

They can’t take away my freedom! — Они не могут забрать мою свободу.

Проиллюстрировать поможет классика рока — группа Ramones. 

При переводе фразовый глагол take away очень вариативен. Поэтому всегда нужно обращать внимание на контекст. К примеру, фраза «take away your beard» означает «сбрей свою бороду». 

Второе распространенное значение — преграждать или мешать. 

I hate that my job takes me away from home on weekends. — Я ненавижу то, что моя работа не дает мне побыть дома на выходных.

Третье — брать еду на вынос.

Do you want to eat here or take the meal away? — Вы хотите есть здесь или взять еду с собой?

Take away или takeaway — это преимущество британская фраза. В США чаще используют take out или to go.

Четвертое — вычитать как математическое действие. Да, полный синоним слова «минус». В американских школах фразовый глагол используется чуть ли не чаще, чем привычный нам minus. 

Five take away two equals three. — Пять минус два равно трем.

В учебниках младшей школы есть подобные примеры:

Теперь немного о более редких значениях. Их всего два. 

Пятое — сохранить в памяти. Своей, естественно, не компьютерной. Зачастую используется в значении «запомнить что-то, чтобы вернуться к этому позже». 

I’ll take his idea away and we’ll talk about it later. — Я запомню эту идею и мы поговорим о ней позже.

Take on 

Если значение предыдущего фразового глагола были хотя бы в одном семантическом поле, то тут уже все вразнобой. 

И начнем с песни, которая уже давно стала мемом. Она показывает сразу четыре значения фразеологизма.

В припеве есть фраза «Take on me, take me on». И она настолько двусмысленная, насколько вообще может быть. Первую часть можно перевести как «коснись меня» и как «дай мне шанс». Вторая может обозначать и как «возьми меня» в том самом смысле, и как «прими мой вызов». 

Самое интересное, что в контексте одинаково хорошо воспринимаются все значения. Поэтому слова песни каждый понимает в меру своей испорченности.

Take on также может означать «взять на себя». Это пятое. Ответственность, обязанности, ношу — так сказать, более конкретизированная форма глагола take. 

We are ready to take on such an obligation immediately. — Мы готовы принять на себя такое обязательство незамедлительно.

Шестое значение — нанять кого-то на работу. Ходовой фразовый глагол у рекрутеров вместе с обычным и знакомым hire. Обыденное значение, без нюансов и подтекста. По сравнению с другими аж скучно.

They’ve agreed to take him on for a year after he finishes college. – Его обещали взять на работу на год после окончания колледжа. 

Седьмое — привезти, доставить. Обычно в этом значении его активно используют логисты. 

The ship took on cargo in Norfolk yesterday. — Корабль вчера доставил груз в Норфолк.

Take back

С этим словосочетанием чуть проще. Потому что back как будто намекает, что здесь все будет связано со словом «назад». И по сути так и есть. Наверное, это один из немногих фразовых глаголов, все значения которого можно понять, исходя из контекста.

Первое значение — «забрать что-либо». Самое логичное и распространенное значение. 

You owe me 1000 dollars. I wanna take my money back. — Ты должен мне 1000 долларов. Я хочу забрать свои деньги.

Вообще со значением «забрать обратно» можно использовать и get back, и have back, и еще много разных фразеологизмов. Тут все решает слово back.  

Второе — «забирать свои слова обратно». Разговорный вариант фразы, который используется довольно часто.

No, I was wrong. You’re a good actor, I take it all back. — Нет, я был неправ. Ты хороший актер, я забираю свои слова обратно.

Третье — вспоминать прошлое, мысленно возвращаться в прошлое. Это значение хорошо иллюстрирует трек Logic — Take It Back

Take it way back — тоже допустимая вариация фразы. Ее смысл от слова way не меняется, она всего лишь звучит чуть более высокопарно.

Четвертое — повторить что-нибудь. Синоним слова repeat. Чаще всего используется как художественная замена обычному слову. К примеру, точно как в треке Джастина Тимберлейка.

Вот тут нужно быть чуть более внимательным. Потому что «Take back the night» может означать и как «Давай вспомним ту ночь» и «Давай повторим ту ночь». В песне — второй вариант, но смысл полностью зависит от контекста.

Пятое — возобновить отношения после расставания. Формально это лишь один из смыслов фразы «взять обратно», но в бытовой речи используется очень часто.

She has forgiven him, and taken him back. — Она простила его и теперь снова с ним.

А для музыкального примера используем популярную американскую группу из 70-80-х The fantastic four, которая существовала задолго до того, как Marvel зарегистрировал этот бренд.

Take aback

Не путать с take back. У этого фразеологизма всего одно значение, но оно сильно отличается от предыдущих. Переводится оно как «шокировать, удивлять».

Примерно так:

I was a little taken aback at the directness of the question. — Я была немного удивлена от прямоты вопроса.

Этот фразовый глагол используется не так часто, но в нем больше всего ошибок у студентов, которые изучают английский как второй. Если многие другие словосочетания с take можно понять с помощью логики, то этот никак не получится. Нужно точно знать.

Take off

Очень часто студенты изучают всего одно значения этого словосочетания. Но на самом деле их больше, намного больше.

Первое и известное всем — снимать одежду. 

It was hot so I took my jacket off. — Было жарко, поэтому я снял свой пиджак.

Собственно, смысловое поле здесь довольно узкое. Тут либо вполне прилично снимать из себя какую-то деталь одежду, либо раздеваться полностью и все, что с этим связано. 

И пример неожиданно подъехал от Лазарева. Песенка не хитяра, но фразовый глагол там именно в том значении, о котором мы говорим.

Собственно, с основным значением все. Остальные смыслы либо разговорные, либо сленговые, либо редкие. О них тоже немного расскажем

Второе — отрываться от земли. Обычно так говорят, когда летательное средство начинает взлетать и шасси теряют контакт со взлетной полосой. Здесь акцент именно на процессе взлета, а не на самом полете.

The plane has been cleared to take off from runway 3. — Самолету разрешили взлет с полосы номер 3.

Третье — уходить в отрыв. Сленговая фраза, которая прямо связана с предыдущим смыслом. Тоже «отрываться», но в смысле «тусить и кутить». В культурном обществе считается низкой лексикой, но это не мешает ей оставаться популярной среди молодежи. 

В песнях ее тоже используют:

Четвертое — имитировать, пародировать. В основном касается выступлений со скетчами и стендапами, в которых артист пародирует голос и/или поведение известных личностей. 

Kirill Nechaev takes off lots of popular singers. — Кирилл Нечаев пародирует множество популярных певцов.

Пятое — становиться успешным, процветать, преуспевать. Тут никаких неожиданностей, все довольно просто.

The business has really taken off this year and has made quite a profit. — Бизнес реально процветает в этом году и обеспечивает доход.

Шестое — отправляться, уезжать. Синоним слова depart. Но на вокзалах и в аэропортах вы его не услышите — оно считается неформальным.

Your plane takes off in 15 minutes. Hurry up! — Твой самолет отправляется через пятнадцать минут. Поспеши!

Take over 

Интересно, что многие идиомы с take часто дублируют смыслы. Это одна из причин, почему они настолько путаные. И самый сок в том, что часто они вообще не привносят никаких нюансов.

Первое значение — становиться успешным. Ничего не напоминает? Take over часто имеет тот же смысл, что одно из значений фразы take off. Разницы вообще нет — в этом плане они полностью идентичны.

Второе — брать ответственность. Да-да, тут тоже совпадение. У нас было такое со словосочетанием take on. Поэтому сразу дальше, к тем смыслам, которые хотя бы не повторяются.

Третье — завоевать, захватить. Любые синонимы, которые передают смысл взятия чего-нибудь силой. Преимущественно используется в контексте истории и военного дела. Самым близким соответствием будет слово conquest.

Ancient Rome took over all of Europe and a bit more. — Римская империя завоевала всю Европу и немного больше.

Четвертое — выкупить долю в бизнесе. Вот это уже довольно узкое смысловое поле.

Elon Musk is to take ABC Group over this week. — Илон Маск собирается выкупить ABC Group на этой неделе.

Но есть одна особенность. Take over звучит чуть более пренебрежительно, чем нейтральное buy out. По смыслу оно ближе к «захапать», чем просто к «приобрести». Корреляция с предыдущим значением прослеживается вполне себе четко. 

Если в более широком смысле, то take over можно трактовать как «наложил лапы». Этот фразовый глагол все же несет в себе оттенок грубости, поэтому использовать его стоит аккуратно.

Take for

Последний на сегодня фразовый глагол. А то если мы будем описывать полностью все значения, статья рискует превратиться в бесконечный длиннопост.

Первое и основное значение — «принимать за кого-то». Никаких сюрпризов. Разговорная фраза, но довольно часто используемая. Особенно в форме следующего вопроса.

What do you take me for? — Ты за кого меня принимаешь?

Также фразеологизм можно использовать в смысле «обознаться, принять кого-то за другого». Поэтому нужно грамотно использовать контекст. А в разговоре еще и интонацию. Перепутать здесь проще простого.

Есть еще второе, сленговое значение фразы — «кинуть на деньги». И это просто идеальный перевод идиомы на русский. Точно с тем же смыслом и характером фразы. 

John is angry that Jack took him for $100K. — Джон злится, что Джек кинул его на 100 тысяч долларов.

В результате получается, что примерно половину из значений фразовых глаголов со словом take можно сообразить из контекста предложения. И это ого-го как много. Так что его можно назвать самым дружелюбным к изучающим английским. Но с сарказмом, конечно, потому что вторую половину значений нужно учить. Они часто странные и сильно не очевидные. Впрочем, как и другие фразовые глаголы. Именно поэтому приходится запоминать десятки вариантов, как их можно трактовать.

There are not any rights that can be taken away. Rights, natural
rights as distinguished from civil rights or statutory rights, are
inherent in people and not preexist governments therefore
governments can not grant those rights, then governments can take
those rights away. When it appears that governments do, that
appearance lacks the proper perspective. When governments take away
the natural rights of people they did so because those people
surrendered their rights. The tapestry of freedom has long since
been stained with the blood of those across the world, through out
history who dared stand tall and defend their rights. Untold
millions of people throughout history as do today, living in
substandard conditions in some prison because they dared to stand
tall and fight for freedom. For those people, despite the
governments best efforts, no rights were taken away, only
disparaged, abrogated and derogated, but never taken away.
